The Pinal County Board of Supervisors convened three separate executive sessions on Sept. 16 to seek legal advice from outside conflict counsel on multiple matters involving the County Attorney’s office and a contested memorandum of agreement.
Agenda materials show the Board sought counsel on whether Pinal County Attorney Arizona POST-certified investigators have law-enforcement powers and, in a separate matter, discussed Pinal County v. Miller, No. CV2026-008061 (Maricopa County Superior Court), noting prior authorization in January to the law firm Snell & Wilmer to seek to void or enjoin a 287(g) Task Force Memorandum of Agreement dated Aug. 28, 2025. The Board also obtained advice regarding its Feb. 11 referral to the Arizona Attorney General alleging misuse of public monies and failure to retain public records by the County Attorney’s office.
The executive sessions were recorded in the agenda as convened; no public action was taken from the executive sessions on the floor. The items in the agenda list outside conflict counsel and counsel names in connection with these matters, but the public record in the agenda does not include substantive legal arguments or the Board’s deliberations from those closed sessions. The Board’s convening of multiple legal advisories continues a sequence of legal steps reflected in the docket for 2026.
