The Midway City Council discussed regulations for animals on the Midway Town Square at its Sept. 14 meeting and agreed to retain stricter rules for the square while allowing city-approved event exceptions.
Community Development Director Michael Henke told the council that "the current code prohibits all animals on the Square unless specifically authorized by the City." Council members expressed concerns about dog waste, safety risks such as biting or dogs entering others’ space, liability for the city, and distinguishing legitimate service animals from emotional-support animals. Members favored visible signage, complaint-based enforcement, and practical approaches rather than aggressive policing.
Council members supported allowing exceptions for approved event animals — examples cited included reindeer, livestock displays, and organized dog activities — and directed staff to add an animal-related question to event applications and to restore signs stating that animals are prohibited. The council also asked the city attorney to advise on which official or body may grant exceptions under the phrase "permitted by the city," and agreed that the mayor may approve routine exceptions while controversial requests should come to the council for decision.
The discussion emphasized balancing community preferences for a safe public gathering space and enforcement practicality. No code amendment was adopted at the meeting; staff actions and legal clarification were the agreed next steps.
