City staff presented Ordinance 2026-25, proposed to amend Midway City Code section 16.13.270 to set a tiered limit on the number of vehicles visible outside properties that operate as home occupations. "The idea here is the number of vehicles that's visible parked in front of a property with a home occupation is limited by the acreage amount," said City staff member Michael during his presentation.
Council members questioned definitions and enforcement details (what counts as a vehicle, whether registration matters and whether recreational ATVs should be counted). After debate, a motion was proposed to approve the ordinance with adjusted counts for the three acreage tiers: 3 vehicles for the smallest tier, 5 for the mid tier and 8 for the largest, and to clarify that any vehicle parked outside the garage counts toward the limit. Council members indicated support and the chair called the motion, moving the ordinance forward for adoption.
Michael noted enforcement can be applied through existing business-license and code enforcement processes and said the city can apply the updated code to existing licenses when violations are discovered. Council also asked staff to clarify the draft language to explicitly define vehicle types and whether registration status affects counts before final adoption.
