Committee members adopted an amendment that lets the planning board modify reduced setbacks in ZTA 26-09 after site-specific review. The change shifts a blanket 100-to-50-foot reduction to a more discretionary, compatibility-focused standard.
Council staff explained that the planning board and the county executive raised concerns about a direct reduction to 50 feet for repair-major uses in the RVC overlay, and the amendment would permit the planning board to "modify the setbacks, that do not qualify for an exemption if it finds that modified setbacks are sufficient for compatibility with adjacent uses and meet the intent of the overlay zone." The Chair accepted the amendment without objection and it was incorporated into the amended ZTA that the Committee recommended to the full council.
Supporters of the amendment argued it preserves neighborhood compatibility while allowing relief for auto-business operations on a case-by-case basis. The amendment was recorded as a substantive change to how setbacks will be applied if the full council adopts the ZTA.
