A procedural issue raised at the Sept. 14 District Council meeting led members to remand the Grove at Hyde Landing rezoning application back to the zoning hearing examiner.
Stan Brown of the People's Zoning Council explained that a recently transmitted minor amendment/sectional map amendment (SMA) affects the Grove at Hyde Landing property and, under county ordinance, requires pending zoning map amendment applications within the SMA area to be stayed and remanded to the examiner for further processing. Brown told the council the SMA transmission on Sept. 4 triggers statutory processing requirements and a remand is necessary.
Councilmember Harrison moved to remand the Grove at Hyde Landing case to the zoning hearing examiner; the motion was seconded by Ms. Ivy. The council conducted a roll-call vote and the motion carried 7-0. The council did not hold oral argument on the rezoning application because of the SMA-related processing stay.
The remand is procedural: it returns the case to the zoning hearing examiner while the district council processes the transmitted minor amendment/sectional map amendment and any required follow-up hearings.
