The Prince George's County District Council voted unanimously on Sept. 14 to remand the Grove at Hyde Landing rezoning case back to the zoning hearing examiner after a procedural conflict tied to a recently transmitted sectional map amendment.
Stan Brown of the People’s Zoning Council told the council the planning board transmitted a minor sectional map amendment Sept. 4 that triggers processing rules requiring pending rezoning applications in the affected area to be held or remanded. "Upon transmittal of an endorsed sectional map amendment to the district council, the planning board shall postpone accepting or processing any zoning map amendment applications within the area of the endorsed SMA until after final action by the district council on the endorsed sectional map amendment," Brown said, citing the ordinance-based process.
Councilmember Harrison moved to remand the Grove At Hyde Landing to the zoning hearing examiner; Miss Ivy seconded. The council took no oral argument on the Grove case and carried the motion 7-0 on roll call.
The remand means the examiner will hold the case pending the district council's consideration of the sectional map amendment (SMA). Council members and staff said the remand followed from the ordinance's procedural trigger rather than a substantive ruling on the rezoning request.
