Charlie Gottlieb, land‑use counsel for Oldest Lighthouse LLC, told the committee the project has full DRB and planning approval and construction started the same day. He described the planned awnings and canopies, their projections into the sidewalk airspace and minimum clearances.
"We have an approved mixed use building... 2 ground floor, 4 retail units, 25 residential units on the 2nd Floor and above, 36 parking spaces on the 1st Floor and below grade," Gottlieb said, then described awning projections: "The entry door canopies are 5 feet, extend 5 feet out into Pavilion Place and 3 feet 3 inches onto Caroline Street..." He also noted the project includes heated sidewalks to assist snow removal.
Committee members asked whether the city has charged an annual fee in comparable cases such as the Adelphi. The chair said staff should look for precedent and, if a fee is appropriate, inform the applicant. The committee voted to have staff draft a license agreement reflecting the dimensions shown on the submitted plans; the motion passed unanimously.
The committee asked staff to circulate the draft license to the applicant and to report back if the committee decides a fee should be imposed based on precedent.
