The council approved a water-improvement agreement for Mountain Bay Subdivision that establishes developer responsibility for constructing culinary water infrastructure and paying impact fees. Planning staff explained the subdivision cannot easily connect to existing city water and the developer coordinated with the Bear River Water Conservancy District to secure an 11 acre-foot annual allocation to serve the project.
Planning staff said the agreement separates improvements that will be dedicated to the Conservancy District from those dedicated to the city and includes exhibits with legal descriptions and estimated costs. “...they worked with the River Water Conservancy District, and the city petitioned, with the Conservancy District for 11 acre feet of water annually,” planning staff said. The council moved and seconded approval of Resolution 2026-14 and approved it on a roll-call vote.
Councilors asked how Bear River would treat usage above the 11 acre-foot allocation; staff said the agreement addresses the projected needs for the development and that any larger usage would be dealt with by contract adjustments and rate structures. Staff also noted Pineview will remain the secondary (non-culinary) water provider for irrigation in the subdivision.
