The La Crosse City Council voted to suspend Bennett O'Reilly's Class B beer and liquor license for 10 days, amending the start date to Sept. 28 to reduce financial hardship on employees.
During deliberations, a representative for Bennett O'Reilly's, identified as Darren, told the council he "can understand and respect" the J&A committee's 10-day suspension recommendation but asked that the suspension be moved to Sept. 28 so staff could save for upcoming rent and paychecks. Darren said shifting the dates would "give my staff a chance to save some money and kind of know what they need to do as far as their finances go." (Representative Darren)
Assistant city attorney Gideon Wertheimer said the J&A recommendation was for a 10-day suspension and deferred the determination of specific dates to the council. Councilmember Petros moved for the 10-day suspension consistent with the committee recommendation; Councilmember Calo proposed an amendment to begin the suspension Sept. 28. The amendment passed 9–4, and the council then approved the resolution as amended.
Councilmembers who spoke during the discussion referenced state law requiring a minimum suspension when the convictions are proven. Councilmember Mandel said the law imposes a minimum 10-day suspension if the offenses are established; he also expressed discomfort with picking dates that might create unequal treatment across cases. Councilmembers who supported the delayed start cited the financial impact on employees and the hospitality sector.
Next steps: The suspension will take effect on Sept. 28 for a consecutive 10-day period as approved by the council.
