The Judiciary and Administration Committee took up a second contested hearing Sept. 2 for Moonshine on Vine LLC, doing business as Dells Bar (229 3rd Street North; Legistar 26-0880). Assistant City Attorney Gideon Wertheimer told the committee the city is not seeking revocation but presented evidence of three convictions in the licensing year and left penalty to the committee.
Sergeant Danny Mandujano testified that Dells Bar failed compliance checks on Sept. 10, 2025, and June 3, 2026, and that one server had a preliminary breath test of 0.108 while on duty. "They were able to purchase alcohol... the bartender... provided a breath alcohol concentration of 1.08," Mandujano testified (transcript evidence; breath values as reported in testimony). Tammy Plourde, the agent for Moonshine on Vine, described implementing stricter policies, training materials, an ID scanner and a strict 21-and-over policy after the incidents and submitted letters of support and documentation to the record.
Plourde emphasized long involvement in local hospitality and said she had documented procedures and a 'binder of useful stuff' including Chapter 125 and staff checklists. The committee made no decision at the hearing; members voted to convene in closed session to draft a written recommendation and scheduled the committee to finalize that recommendation on Sept. 10, 2026, ahead of the city council meeting the same evening.
