The Bridal Planning and Zoning Commission approved planning variance PV26‑620 to permit a 1.89‑foot variance from the standard 5‑foot side building setback for an accessory structure at 505 Ash Street.
Mikaela Dickinson, staff planner, said the accessory structure predated an updated survey that revealed the encroachment and that the owner removed two other encroachments before the hearing. Dickinson recommended approval, saying the property is surrounded by RD‑5 zoning and the remaining 0.89‑foot encroachment does not create adverse impacts on neighboring properties. "Approving the variance would allow for the continued use of an accessory structure that is already existing," Dickinson said.
Commissioners asked whether the certificate of occupancy (COO) was held because of the survey; staff explained the building permits and inspections process revealed the discrepancy and that obtaining a COO was contingent on addressing encroachments. A motion to approve the variance carried unanimously. Staff noted 19 notices were mailed and one adjacent property owner called for clarification but reported no objection so long as the encroachment does not extend onto their property.
