The Lake County Board of Supervisors revisited a contested land-use decision on Aug. 25, moving under county procedural rules to reconsider and rescind actions it had taken on Aug. 18 regarding an appeal of major use permit PL2571 (referred to in the meeting as "Pasta Farms").
County staff summarized the process and the specific rules (chapter and section references were read into the record) that permit the board to reconsider and rescind prior actions when members indicate they may want to change a vote. After staff explanation, the board opened the item for public comment.
Neighboring residents and an appellant's representative said the project record did not support the findings needed for approval. "The project record did not support the findings necessary for permit approval," Margo Kambara told the board, citing concerns previously raised at the Planning Commission about tree removal, groundwater availability, roadway safety, wildfire evacuation and traffic on narrow roads.
Board members then made a sequence of motions: to reconsider the Aug. 18 approval, to rescind the Aug. 18 action, to reconsider the Aug. 18 action granting the appeal in part with amendments, to rescind that grant, and finally to approve findings of fact and decision and authorize the chair to sign. The board concluded by moving to grant the appeal in part with the amended Exhibit E and recorded votes of "aye" with no opposition on each action; the clerk announced results as carrying 5-0.
