The Clerk read the motion as recorded: "Moved by Dickson, seconded by Beck at 9:00 a.m. a motion to close the meeting for discussion of strategy with counsel in matters that are presently in litigation or where litigation is imminent where its disclosure would likely to prejudice or disadvantage the position of the governmental body in that litigation pursuant to Iowa Code Section 21.5(1)(c). The Board may consider and take action regarding the litigation after returning to open session." The board reconvened in open session at 10:11 a.m., then voted again at 10:22 a.m. to go back into a closed session on the same statutory basis; that second closure likewise passed 4–1, with Supervisor Bribriesco voting Nay.
