The Castle Rock Board of Adjustment voted unanimously on Sept. 3, 2026, to approve a 35-foot front-setback variance to permit a detached garage at 3671 Rocky View Place. The variance reduces the required 50-foot front setback so the garage will sit 15 feet from the property line, as shown on the submitted plot plan; the motion passed 5-0 on a roll call vote.
Staff explained the lot is long and narrow and that earlier aerial-photo measurements used in prior materials did not match the applicants’ intended dimensions. Staff showed survey drawings and elevation plans and noted the applicant had obtained letters of support from neighbors and the homeowners association. Staff also said the garage will use the existing driveway and is sited to minimize removal of existing vegetation.
Applicant Tammy Yarnell told the board the proposed garage dimensions were part of the original submission and that the variance request arises from the difference between aerial-photo measurements and the intended on-the-ground dimensions. “When we submitted our for our building permit, then we noticed that the variance letter said 25 feet…that’s nothing’s really changed,” she said, explaining the clarification was a measurement issue rather than a change in plans.
The board reviewed the municipal variance criteria — including unique physical conditions and that strict compliance would create practical difficulty — and concluded the hardship had been demonstrated for this property. The chair moved to approve the variance and the motion was seconded; the roll-call vote was 5-0. Staff said a permit will be approved once the applicant completes payment and processing.
