Duque said staff had reviewed surrounding-city ordinances and found most nearby jurisdictions either do not include a similar provision or define it narrowly; staff also reviewed recent local uses and found three instances in the past three years, with one tabled and inconsistently processed.
Council members asked whether the repeal was prompted by the Warwick demand letter (staff said no and deferred to others for details), whether the item had been benchmarked against other jurisdictions (staff said they had done a limited review), and whether repealing the section would require Planning & Zoning review and public notice (staff confirmed the text amendment requires both). The council directed staff to bring the repeal back at a future regular meeting after Planning & Zoning review and the required public-notice process.
