Council considered a legal-notice authorization for an annexation, including a corrected hearing date, after a resident raised concerns about the map attached to the notice.
A resident said the case map’s LUIS designation showed Level 2 (urban residential) for the parcel while surrounding properties were LUIS Level 1, which the resident said is the only authorized LUIS level for agriculture under table 4.1 of the comprehensive plan. The commenter asked the city to revise the attachment so the annexation notice would not give the appearance of preempting rezoning or favoring a developer.
City planning staff responded that when property is annexed it is brought into the city as agricultural (AG) and that rezoning would be a separate subsequent application. Staff pointed to the case map as showing the tract as agricultural and said the comprehensive plan’s Level 2 designation is not being changed by the annexation action. The council moved to publish the notice with corrected dates; staff said the rezoning process would follow later if requested.
"Whenever we annex property in, we automatically bring it in as agricultural property and then the rezoning would be a next step and another application," a planning staff member said. The resident maintained the attachment should be aligned to show the AG designation to avoid confusion for readers of the notice.
Council approved moving the annexation item forward with corrected publication dates for the notice; staff will publish the corrected notice and subsequent steps on rezoning will follow the city's public-notice and hearing procedures.
