IHPC staff described an extensive history of repair orders and recent vacancy notices for the property at 324 Burgess Avenue and asked the commission to require the owner to make prioritized repairs and report progress at the December hearing.
"We're requesting a 90 day compliance, so that would be by 12/01/2026 in order to come and appear in the December hearing if nothing is done," staff architectural reviewer Caroline Emmenaker said, noting the foundation, roof, siding and porch were flagged as immediate priorities by the Department of Business and Neighborhood Services (BNS).
Staff told the commission it had removed the property from demolition orders after some foundation work but that additional repairs remain and new vacancy orders carry fines. Staff said it will file a complaint with the prosecutor's office and continue discussions with Indiana Landmarks about a possible receivership if the owner does not meet the 90-day timeline.
Owner Maderas, who said he bought the house as a difficult project, told the commission he intends to perform much of the work himself with occasional help and that materials are on-site. He asked for the opportunity to complete repairs and return with a progress report; he also disclosed recent medical issues that affected his ability to work earlier in the last year.
Staff and the commission agreed to let the owner attempt repairs and return in December with a progress report; if the property remains out of compliance, staff will pursue legal options including a prosecutor referral and possible receivership arrangements.
