The council authorized an increase to the city's outside legal-services authorization for counsel representing the city in litigation identified in the staff report as Cummings v. City of National City.
During discussion councilmembers and speakers reviewed the requested increase (an additional $75,000 to raise the maximum authorization to $250,000) and noted prior spending of approximately $175,000. A councilmember asked whether the city could be liable for the opposing side s attorney fees if the city loses; staff agreed that in part such liability could be possible and that insurance coverage mitigates direct general-fund impacts but contributes to higher future premiums.
Public commenters urged the council and incoming administration to focus on training, leadership and clear protocols to avoid future incidents that lead to litigation. One public speaker said repeated promotions without accountability have contributed to culture problems and called for procedural reform.
Council moved, seconded and approved the item as presented.
