After returning to open session at about 10:04 p.m., the DEL VALLE ISD Board of Trustees adopted the investigator's procedural and substantive findings and took specific action on seven requested remedies arising from the consolidated Level 3 grievance.
Secretary Wagner moved that the board adopt the "procedural and substantative findings pages 8 through 24," a motion that carried 5-2. Trustees then considered each requested remedy in turn. The board granted the investigator's response to item 1 (motion passed unanimously), granted the remedy related to finding-of-fact item 2 as suggested (motion passed 5-2), and approved requested disciplinary actions (item 3) as modified in the findings (motion passed unanimously).
For remedy 4 (intervention regarding alleged defamation), the board accepted the investigator's recommendation to grant relief in part; for remedy 5 (a requested formal clarification, correction or retraction), the board rejected the recommendation. Remedy 6 (full opportunity to review and respond) was granted in part and denied in part consistent with the investigator's recommendation, and remedy 7 (appropriate administrative and personnel process) was granted. Several of the remedy votes were unanimous; two substantive votes were recorded as 5-2.
The motions and votes left the investigator's findings and the board's remedial directions on the record; trustees adjourned the special meeting shortly after completing those actions.
