At the end of the hearing, a commissioner moved that the commission find the Cumberland Energy Center substantially in accord with the comprehensive plan and to recommend that the Board of Supervisors approve CUP 26‑03 with staff‑recommended conditions.
Recorded votes show the recommendation carried with five commissioners voting yes and one voting no. The recorded yes votes included Matt Seal, Kevin Meadows, Hubert Allen, Steve Rosen and William Flippen. Commissioner Steve Donahue recorded the single no vote on the CUP recommendation.
Commissioner Richard Donahue read a prepared statement in which he proposed several conditions he said were necessary to protect the county and nearby residents: (1) explicit language requiring compliance with applicable local, state and federal laws, (2) guaranteed funding and defined terms for decommissioning so the county is not left with remediation costs, and (3) clearer, time‑bound decommissioning and mitigation commitments for affected neighbors. Donahue said he could not recommend approval without those items incorporated into the final conditions presented to the Board of Supervisors.
The commission's recommendation forwards the CUP and staff conditions to the Board of Supervisors for final action. County staff and commissioners emphasized that state approvals (DEQ air permit, transmission interconnection and SCC filings) and final site‑plan submissions are still required before construction can commence.
