The Unified Government Commission on Aug. 27 refused to override a Planning Commission recommendation and left a previously denied special-use permit for a non-owner-occupied short-term rental at 1710 North 90th Street unchanged.
Applicant John Badgley appeared remotely and said the house had been used without incident during the World Cup and that he had not been individually notified of a prior hearing while he was traveling. “My name is John Badgley, and we're applying for a short term rental permit here at 1710 North 90th Street,” he told the commission, adding he and co-owner Philip Loudon were willing to comply with any conditions staff required. Planning staff said the Board of Planning and Zoning recommended denial (4–2) because of neighborhood incompatibility and because the applicant did not attend the Planning Commission hearing. Commissioner Carlos Pacheco moved to approve the permit, but the roll-call vote was 2–8 and the motion failed.
Legal counsel explained options available to the applicant: he may appeal a denial to district court or reapply; if the application is older than six months it would require new inspections. Staff told the applicant they would follow up to clarify which items need correction. The commission did not adopt additional findings or conditions at this meeting, leaving the Planning Commission denial in effect.
