City staff told the Lucas Board of Adjustment that a segment of the board‑on‑board fence at 23 Cedar Bend Trail was constructed before a permit had been issued and that code enforcement had opened a case.
The staff presentation explained that the code (3.19.002(b)) requires fences in required yards to be at least 50% see‑through and that an initial permit application proposing a 6‑foot solid board‑on‑board fence was denied for that reason. Staff said the applicant later submitted amended plans showing a lower covered section for animal protection with 4‑inch spacing between pickets above that section, but that the permit fee had not been paid. As staff noted in the presentation: “An invoice showed a $75 due and 0 paid.” Staff further said, “If they went with what the amended plans were, they would have had a permit for that.”
Staff flagged that the fence placement was described as 6 to 8 inches inside the property line and that the site plan did not include detailed fence material specifications. The staff report also noted that certified mailings had been sent to the property owner as part of code enforcement.
