Nina Dossi of Vertex Consulting represented the property owner and told commissioners the application meets the LDC either as a convenience store or, if necessary, as a similar permitted use under §5.3.0.6. Dossi reviewed code rules of construction, definitions (convenience store vs. gas station vs. truck stop), and a concept plan demonstrating that the site can meet dimensional, setback and drainage standards.
"Because the proposed Buc‑ee's meets the code definition of a convenience store, a permitted use by right, the requested determination should be approved," Dossi said during her presentation. She pointed to prior county examples and to the land use code language that permits fuel sales as part of a convenience store. The applicant also provided a trip‑generation memo (PM peak hour ~1,679 trips) and conceptual site plans intended to show that the development can meet the objective engineering and setback requirements that the county enforces at site‑plan review.
The board accepted the applicant's legal reading in its majority vote; commissioners who supported approval cited the literal text of the code and the board's prior interpretations as persuasive.
