Black Hawk County adopts construction-evaluation resolution for confinement feed operations; supervisors note limited local authority

The Black Hawk County Board adopted a construction-evaluation resolution on Jan. 2 that authorizes the county to submit recommendations to the Iowa Department of Natural Resources on proposed confinement feed operation structures under Iowa Code 459.304(3). Supervisors explained the resolution permits the county to provide an adopted recommendation to the DNR and, where applicable, contest a DNR decision if the county has adopted a construction evaluation resolution.

During discussion supervisors observed that while the resolution gives the county a formal channel to comment and potentially contest DNR rulings, the state retains ultimate permitting authority. One supervisor said the county's role provides additional information to the DNR but is often "toothless" in terms of final control; another described the issue bluntly as "It's the hog," underscoring the agricultural nature of permitting. The board adopted the resolution by roll-call vote.
