Nyack board awards Memorial Park shoreline pathway contract to ATEC

The Village of Nyack Board of Trustees voted unanimously Feb. 20 to award resolution 26-35, authorizing a contract for the Memorial Park Shoreline pathway to the bidder the engineering consultant recommended, ATEC. The board’s discussion centered on the distinction between the lowest monetary bid and the 'lowest responsible bidder' under the cited New York State competitive-bidding standard. Speaker 5, addressed as Andy, summarized the consultant’s recommendation as the basis for selecting ATEC rather than the lowest-priced bidder.

Mayor (Speaker 1) explained the board’s obligation to consider experience and the likelihood of a successful completion when selecting a contractor, saying that in some cases 'price is not...always the determining factor' given specialized shoreline work that may produce overruns for an inexperienced contractor. The resolution was moved, seconded, and carried on a recorded voice vote: the motion passed unanimously. The board indicated the contract includes a target completion in late June and that bond or other municipal financing will cover the project shortfall not covered by state funds.
