Planning Board backs updated stormwater code to align with state rules and add enforcement

Carter Lake’s Planning Board voted to recommend proposed updates to Chapter 101 (stormwater control) that city staff said would align the local code with stricter state requirements and add enforcement and maintenance language.

Elizabeth, the author of the draft updates, told the board the revisions add maintenance and inspection requirements, a one‑year compliance/grandfathering period and the ability for the city to enforce maintenance through notices and, if necessary, liens. "It requires an inspection paid for by the owner of the stormwater feature or features on their property to make sure that they are in efficient and operating order," she said. The draft would also require annual inspection reports submitted to a stormwater coordinator to be determined by the city.

Board members supported the concept and moved to recommend the ordinance changes to city council. Discussion noted staffing choices for the stormwater coordinator — which could be a trained existing staffer or an outside contractor — and the need to ensure the city has the resources to administer inspections and enforcement before imposing owner obligations.
