State waives restitution in Mason case after complaining witness fails to provide receipts

In a restitution hearing on behalf of Eric Mason, the prosecutor said the complaining witness had not provided receipts or estimates for claimed losses and that the state could not support a restitution award.

"He has not been able to produce those receipts or estimates," the prosecutor told the court, and asked the judge to waive restitution in light of the lack of documentation. The judge said she would proceed accordingly and asked counsel to attempt to obtain any missing receipts before the next proceeding.

The prosecutor characterized the underlying incident as the defendant being in the wrong place at the wrong time and noted the complaining witness's limited ability to prove a monetary loss, which informed the state's recommendation.
