Commission set to consider short procedural timeline, possible deferral of JTS RFP

Commission advisers proposed concrete procedural steps to address the dispute over valuation methodology in the JTS RFP and commissioners present agreed with those recommendations.

Advisers recommended that the commission "require public service and invite all other parties to file a response by Friday, 08/14/2026," giving parties a short window to respond to CCSA's expedited request. Wheaton said that at the August 12 commission weekly meeting the commission would consider whether to direct Public Service to defer issuance of the RFP until the dispute is resolved, and advisers offered to issue an ABC decision later the same day if the commission wanted that route.

Commissioner Plant and the chair both voiced agreement with the recommendation and thanked advisers and counsel for acting quickly given the late-breaking timing in advance of the RFP issuance. No formal motion or roll-call vote on a deferral or on the advisers' recommendation is recorded in the transcript. The next formal occasion to change the RFP schedule is the commission's Aug. 12 weekly meeting.
