Councilor Prince asked staff to revise the TCEQ application packet to replace a specific email address linked to the former city manager and to allow an addendum explaining known pond construction or liner issues before submission to the Texas Commission on Environmental Quality.
Prince expressed concern that simply checking affirmative boxes about pond construction could expose the city to regulatory scrutiny if problems exist. He proposed adding an appendix or addendum that outlined known pond issues and corrective actions. Staff and council agreed that the addendum should be prepared at staff’s discretion to avoid making inaccurate statements to TCEQ. The motion to authorize the city manager to sign a modified TCEQ application with those caveats passed unanimously.
"My recommendation was that maybe we need to put an addendum on this and say see appendix or addendum A where we simply make a note about the known pond issues that we have and the actions we're taking to correct it," Councilor Prince said during the discussion.
