Resident asks Planning Board to reconsider Rosemarina dock extension, cites riparian setbacks and calls for environmental review

During the public‑comment period, Jill Norman asked the board to revisit the Rosemarina dock extension decision and to issue an immediate stay while alleged inconsistencies in the public record and potential due‑process errors are investigated. Norman said the approved resolution grants a 0‑foot setback along the northern property line and that earlier testimony under oath asserted riparian lines do not move, a contradiction she said deprived neighbors of a meaningful opportunity to object.

"This request is grounded in conflicting testimony presented to the city, misrepresentations regarding the riparian rights and the setbacks and the resulting direct adverse impact on neighboring residential property owners," Norman said, urging a comprehensive environmental review that includes independent analysis of vessel traffic, wildlife disturbance, water quality, stormwater, lighting and noise.

Assistant City Attorney David Toles responded that the Planning Board does not have authority to make a motion to reconsider an item after the meeting at which action was taken or the subsequent meeting; he advised that the next forum for the public to be heard on that item is City Council. Applicant representative Zach Lombardo also said on the record he stands by his earlier testimony that riparian or property lines were not moved in the application.

The board did not take substantive action on the request during this meeting and directed public parties to City Council for any reconsideration or appellate relief.
