Magistrate orders 60 days to remove unpermitted tiki hut at 870 Vaughn Way

The special magistrate found the property at 870 Vaughn Way in violation of City of Delray Beach code section 2.4.13b for installing a tiki hut without a permit. Chantelle Jean Baptiste, a code enforcement officer for the city, told the hearing she issued a notice of violation on June 18, 2026, served certified mail on June 23 and posted the property on June 25; photos and inspections showed the tiki hut remained in place as of August 6, 2026.

"This property has not come into compliance," Jean Baptiste testified as she introduced six exhibits including photos and reinspection notes. The city asked for an extension and a daily fine; the magistrate said he was satisfied the notice was sufficient and ordered the respondent 60 days (until October 5, 2026) to come into compliance or face a fine of up to $100 per day. The ruling noted the hearing was quasi-judicial and that testimony was given under oath.
