Clark County holds public review after DA declines prosecution in Justin Walsh death

Ozzie Fumo, the presiding officer appointed by the Clark County manager, opened a public fact-finding review after the Clark County District Attorney's Office issued a preliminary determination that no criminal prosecution of the officers involved in Justin Walsh’s death was appropriate. Fumo cited Clark County Ordinance Chapter 2.12, which requires a public review following such a determination, and warned attendees that graphic body-worn camera footage would be shown.

Chief Deputy District Attorney Giancarlo Pesci presented the prosecution's case for the review and called Detective Britney Tommaso of the Las Vegas Metropolitan Police Department’s Force Investigations Team as the first witness. The proceeding followed a limited, informal question process: the ombudsman Willard Ewing and the presiding officer could ask questions, but the ordinance does not grant subpoena power or permit outside parties to call witnesses. The presiding officer stressed that "this is not a trial" and that no formal determination regarding cause of death would be rendered by the review.

The review concluded with the presiding officer noting that the DA had provided investigation materials to the ombudsman and that the documents and the recorded video are public records available on the Clark County website. No public questions were raised at the close of the session.
