The Zoning Board of Adjustment remanded a driveway permit dispute involving Jonathan Colon (Smith Corner Road) to the planning board after members found the submission incomplete and possibly filed under the wrong application type.
Colon told the board he had moved the driveway location to a spot he said is safer for pulling out of the lot. "So the reason he didn't give us the the good okay for the driveway is because once you go into the driveway, once for the foundation, the setback gets to 7 feet from the property line," Colon said when explaining the site constraints. Board members and the road agent noted the primary concerns were required setbacks and site distances — the recorded subdivision plan located the driveway differently and a knoll limited sight lines. Members concluded the filing looked more like an appeal of an administrative decision than a variance request and asked that the applicant submit a complete, scaled certified plot plan, an abutters list, and clearer plan sheets.
After discussion the board voted to remand the application to the planning board so those details and any DOT/road‑agent requirements could be resolved. The board instructed staff to notify the applicant about the required documentation and that a public hearing will be scheduled only after the application is complete.
