City of Clear Lake urges pause, says 2011 loan documents not produced before JPA vote

During public comment on the Lake County JPA amendment, Alan Flores, City Manager for the City of Clear Lake, urged the board to delay the membership change and provide the 2011 loan documents underlying earlier financings so city staff could review potential effects on the sanitation system and ratepayers.

Flores said multiple county staff requests for the original 2011 loan documents had gone unanswered and that participants in a prior meeting had left with the expectation the action would be delayed to allow document review. "I am confused and frustrated that, the documents actual loan documents from 2011 that were prepared for this financing... still haven't been provided," he said, asking the board to pause the amendment until the documents could be vetted.

County staff and bond counsel told the board they had reviewed the 2011 bond documents and reiterated counsel’s view that the JPA membership changes would not, by themselves, impair outstanding bonds so long as the authority and the sanitation district continued to observe bond covenants. Staff also said next week was the last possible moment to delay without disrupting their announced timetable.

The board heard the city manager’s concerns but proceeded with the sequence staff recommended; supervisors pressed staff on whether more time could be granted for review, and staff committed to providing available documents and noted the accelerated timeline for the sanitation district’s split.
