Council approves first reading of Ordinance #674 to amend in‑home day care definition amid mixed public comment

The Winterset City Council on Aug. 4 approved the first reading of Ordinance No. 674, amending Section 4.12003 of the Winterset Municipal Code to redefine “In Home Day Care Provider.” The motion to approve the first reading was made by Council Member Mary Ann Orr and seconded by Council Member Michael Eller; the vote was unanimous.

During the public-comment period, several nearby residents raised concerns that the change could increase traffic and allow commercial uses in residential neighborhoods. A resident at 502 W Court “expressed concerns of approving Ord #674 relative to traffic congestion, further concern of other types of business occupying residences for commercial purposes.” Council Member Michael Cook told staff he wanted improved traffic and parking control prioritized immediately, “desiring improved traffic and parking control as previously approved by council, requesting Staff prioritize this immediately.” Supporters said the amendment would help local families access childcare. A resident at 905 N 15th Ave “supported the council’s consideration of amending the Winterset Code,” citing child-care needs and parents’ ability to work.

Attorney Rosien cautioned that the ordinance “is setting a precedence” and that future requests to change residential-property rules would need to reflect that decision. The ordinance clears the first reading; the council has the option to waive subsequent readings or schedule them at future meetings. No final adoption occurred at this meeting.

Next steps: Ordinance #674 remains at first reading; if the council waives or completes the remaining readings the definition change would take effect per the municipal code process.
