Brian McWade pleads guilty to attempted aggravated assault; sentencing reset

Brian McWade waived formal reading of the indictment and entered a guilty plea to the lesser-included offense of attempted aggravated assault with a deadly weapon.

"Guilty," McWade said when the judge asked how he pleaded. The court described an agreement that would result in an eight-year term that would be probated, a $1,000 fine, and restitution to be determined before sentencing.

The judge told McWade the court would order a pre-sentence report and reset the case for sentencing so probation can prepare its assessment. The judge reduced McWade's bond to $1,000 and ordered several conditions if he is released, including a requirement to report to the probation department for the presentence report and an absolute no-contact order with Simone Mullins. The court warned that any new arrest or failure to comply could lead to revocation of the plea agreement.

The prosecutor admitted exhibit number 1 and the judge found McWade competent and that sufficient evidence supported a finding of guilt. Sentencing will occur at the next scheduled hearing after the restitution amount is determined and the pre-sentence report is completed.
