Council advances vacation of unimproved Elm Street right‑of‑way after adjoining owners confirm restrictions

The Village Council opened a public hearing Dec. 14 to consider vacating an unimproved portion of Elm Street. Todd Roden, one of four adjoining property owners, told the council he and the other adjacent owners understood the conditions of the vacation: the bike path and utility easements will remain in place and property owners cannot build structures on the vacated land without village approval. "I explained to them what the vacation meant... and all of them express agreement of those terms," Roden said.

Following public testimony the Administration, Technology and Community Health committee discussed the ordinance and staff recommended approval, saying the request originated with residents. One committee member abstained from the discussion and vote because of a disclosed business interest with a benefitting landowner. The committee voted in favor and indicated the ordinance would be placed on the council consent agenda for final action.
