Zoning board delays decision on proposed recovery home at 417 East Oregon Street

The Lapeer City Zoning Board of Appeals voted 3‑2 on July 27 to postpone consideration of an appeal over a denied zoning permit for a proposed for‑profit recovery home at 417 East Oregon Street. The chair moved to continue the public hearing to the board's next regular meeting on Monday, Aug. 24, 2026, at 6:30 p.m., so members could review "the complete administrative record, including the formal reasonable accommodation request and related written communications," before making a decision.

City planner Wade Burkholder had told the board the applicants submitted a permit to operate a recovery residence accommodating up to 12 unrelated adults in an R‑2 single‑family residential zone and described the matter as implicating a use variance. Board members and several residents urged that all communications and the city attorney’s analysis about the appellants’ invocation of the Fair Housing Act be provided to the ZBA. The board also noted two letters received that day from Walter and Andrea Gallo and from Charisseo Legewski and made those part of the record.

"I move that the public hearing on the appeal of the administrative decision regarding the property at 417 East Oregon Street be postponed and continued to the next regular meeting... on Monday, 08/24/2026 at 06:30PM," the chair said while placing the motion on the floor. The motion was seconded and carried, with the board recording three votes in the affirmative and two in the negative. The continuance leaves the administrative denial in place pending the board's next review of the fuller record.

The hearing had included public testimony both against and in support of the board's cautious approach. The continuance means the public will have another opportunity to speak at the Aug. 24 meeting after the board reviews the materials it requested.
