Selectboard holds second executive session on confidential attorney-client materials; member recuses, no decision announced

Shortly after reopening the morning meeting, the Town Attorney submitted confidential material related to a former employee. The Selectboard debated whether to defer to allow a member to obtain outside counsel but ultimately voted to enter a second executive session to receive attorney-client communications.

Brian Gehlich moved the board into executive session at 10:16 a.m. under 1 V.S.A. § 313(a)(1)(F) to receive confidential legal advice; Katie Fitzpatrick recused herself from that portion of the meeting and was invited back after the closed session. The recording ended for the closed session; Chair Denis Benson reopened the public meeting at 10:55 a.m. and announced that no decision had been made during the executive session.

The board characterized the second session as a review of confidential attorney-client communications; no public record of a decision or outcome was produced at the meeting. The Selectboard then moved to adjourn, ending the meeting at 10:59 a.m.
