City staff, attorney say rezoning application met procedural requirements; paper maps were inaccurate, staff says

City staff and the City Attorney told the Council on Jan. 21 that the rezoning packet met applicable procedural requirements and that the Planning & Zoning Commission recommended approval.

Community Development Director Ternet clarified that will‑serve letters from the Sun Valley Water & Sewer District are required for new subdivision applications but are not required at the rezoning stage, that all noticing requirements had been met, and that a development agreement was not applicable because no plans were submitted. Ternet also told the Council that several maps published in a local newspaper were incorrect or invalid.

City Attorney Johnson said he had reviewed materials submitted by Protect Prospector Hill, Inc., and had no concerns that would prevent the Council from proceeding with the rezoning first reading. He asked the Council to focus on findings and legal analysis and to direct staff to return with revised findings for the second reading.
