The police policy and code services committee voted to place on the consent agenda a special-use request that would allow the owner of 917 S. Of Valley Lane to build with a 29-foot rear-yard setback instead of the 40-foot setback required by code.
"The zoning board of appeals reviewed this and unanimously recommended its approval, and staff concurs," said planning staff during the committee presentation. Staff said the property backs up to a detention pond and that nearby neighbors had been contacted and were supportive of the request. Committee chair Councilman Kozlowski called for the vote and the committee approved the measure to go on the consent agenda.
If the council approves the consent agenda, the variance will be adopted without further public testimony. The planning staff noted no public testimony had been offered at the ZBA hearing and recommended approval based on conformance with the applicable criteria.
