Council approves retroactive shed easement at 1365 East Carpenter Drive

The council approved a minor variation permitting an existing shed to remain despite encroaching into a public utility easement at 1365 East Carpenter Drive. Staff told the committee the shed encroached five feet into a 10-foot utility easement but that the petitioner had obtained signoffs from relevant utility agencies and surrounding property owners and had recently applied for the required building permit.

Staff described the case as retroactive and told the committee no fines were pending at this time. "It was determined that the petitioner did not have a building permit. We notified him that a building permit was required, and he came in immediately and applied for it," staff said. After committee discussion and no public objection, the council approved the variation through the consent calendar.
