Council continues special-use request for front-yard fence at 433 North Stark

The Police Policy and Code Services Committee deferred action on a petition for a front-yard fence at 433 North Stark after members expressed concerns about sight lines and the fence's visual impact.

Staff described the site as a pie-shaped corner lot and said the zoning-board-of-appeals had recommended approval for a 4-foot picket fence with a 5-foot setback; staff generally concurred. Council members questioned whether a solid picket-style fence would obstruct visibility and suggested an open wrought-iron (aluminum) style or that the petitioner provide a mock-up for line-of-sight review.

The petitioner, Jeremy Hall, told the committee, "What we're proposing is allowed by rights if our site property line along Stark was approximately 7 to 8 feet longer," and argued the requested 4-foot decorative fence with a 5-foot setback conforms with the code conditions for many corner lots. Committee members recommended continuing the item to the next meeting so staff can inspect the location and the petitioner can provide mock-ups of materials and setbacks.

The committee moved and approved a continuation; the clerk later noted the item would return on Sept. 6 because Sept. 5 falls on Labor Day. The item will be revisited with staff feedback and any mock-ups the petitioner provides.
