Council to prepare resolution to consolidate city attorney role after discussion

Council members raised questions about the city's legal representation and the presence of multiple attorneys serving municipal-court and city functions. Naomi Hernandez requested a review of the city attorney position and possible changes to the appointment process for city attorney and municipal prosecutor.

Chair (S4) explained that Cynthia (special counsel working on code and encode issues) had moved to a new firm and that Mr. Kubacek had been filling in. The chair said, "we have to have a resolution to remove him from the council" and that the city will prepare a resolution in time for the next meeting. Attorney Alessandra Gadd (S7) said Cynthia is working on the resolution and confirmed it can be ready for the next meeting.

Council members discussed whether the municipal-court attorney and city attorney roles overlapped and requested clarification of who performs which duties; the attorney advised that removal from municipal-court roles is handled through the court, while removal from a city appointment requires a council resolution. The council directed staff to bring a written resolution to formalize the change at the next meeting.
