Work group weighs changing how self‑reported critical incidents appear on licensing records

Doctor Paul Polito urged the work group to distinguish between incidents a provider self‑reports and incidents that were not reported at all, saying the current records make both look identical and that treatment can penalize transparent providers during partner or employer checks.

"So right now, a provider who calls in immediately, submits the form on time, completes the corrective action, that looks identical on a licensing record to a provider who didn't report it at all," Polito said, arguing that identical flags are an unfair business consequence that discourages timely reporting. He proposed a classification that would retain full transparency — incident type, date and corrective action — while indicating that providers complied with reporting timelines and corrective steps.

Licensing staff acknowledged the concern and emphasized the need to remain compliant with federal CCDBG requirements; they said edits could be made to how entries display while preserving required data. The work group did not adopt immediate regulatory language; staff will capture this feedback and return options in subsequent drafts for the group’s consideration.
