Town attorney proposes affidavit process for cemetery plot transfers; septic-permit authority questioned

Town Attorney Brandon Taylor told the council that Niki Mikes contacted his office about problems transferring cemetery plots because of missing documentation. Taylor proposed an affidavit‑of‑heirship process with a three‑week publication period and a 90‑day contest window, and suggested reissuing rights in uncontested cases. He recommended the policy could be adopted by resolution and possibly codified later by ordinance.

Separately, Mayor Jeff Jensen reported Lincoln County is not approving septic permits in some cases and asked Mr. Peavler (staff) to research and confirm whether the town has authority to issue septic permits within the Afton municipal boundary. No formal action was taken at the meeting on either matter; the council asked staff to research legal authority and options.
