MacGibbon repeatedly warned property owners that state and local rules limit the magistrate’s discretion. "I'm constrained by the ordinance to do only the 90% reduction," he said when explaining the statutory cap on reductions for non‑owner‑occupied properties. City staff echoed that service by posting is legally sufficient for notice under Florida rules, even if a property owner did not receive mailed notice.
Throughout the day the magistrate signed a series of stipulated lien reductions, granted continuances to allow pending building permits and planning reviews to complete, and set compliance dates that generally fell between mid‑September and late January 2027. Several property owners described delays in permit processing, unresolved contractor issues and, in one case, a recent electrical fire that complicated compliance. Magistrate MacGibbon frequently urged owners to coordinate directly with city code and building staff to avoid fines that will resume if ordered conditions are not met by the stated dates.
The hearing ended with the magistrate granting many of the city’s requested compliance dates and some negotiated reductions, vacating older orders where appropriate, and adjourning the docket to allow staff to enter final orders.
