Christopher Henry, appearing for LVNV Funding, asked Judge Tammy Long Hayward to continue the case against Vincent Price for approximately 60 days so plaintiff counsel could consider Price's asserted hardship. "I'd like to request a continuance on this... 60 days up because Mr. Vince Price has a couple of issues that I'd like to consider," Henry said.
Price told the court he is disabled and not working, and that he cannot currently pay the debt. The judge told Price hardship alone is not an automatic legal defense but permitted counsel to explore arrangements and agreed to set the matter about 60 days out. "Mr. Price, are you amenable to that?" Hayward asked; Price consented. The court instructed counsel to notify the clerk if the matter resolves earlier so it can be removed from the calendar.
The continuance creates time for the parties to pursue a negotiated resolution or for plaintiff to consider a hardship accommodation before the court hears the matter again.
