Recount commission hearing leaves county tallies unchanged; equipment remains under state custody

Elections staff updated the board on a recount commission hearing related to the Senate District 23 contest and the county’s role. Staff said requests from one candidate to subpoena or depose county individuals were rejected by the commission; a motion to quash subpoenas passed 2–1 and an oral motion to compel in‑person testimony was also rejected by the same margin.

Staff reported no tally changes occurred across the six counties subject to the recount and praised county teams for their work. The staff member said equipment and some materials remain locked under state police custody while recount procedures and hearings continue; staff emphasized the need for coordination as the August hearings and certification deadlines approach. "They quashed that on a 2 to 1 vote... there was no tally change which verifies that we can all count," staff said.

Board members asked about access to equipment and where ballots and machines have been stored; staff said items have been secured in an iron‑cage storage area or secured storage and that state police locks are presently on the cage while state investigators complete their work. The board and staff discussed scheduling challenges for potential additional hearing days and the timing required to meet candidate certification deadlines.
