Board approves variance to allow attached porch at 3676 Farley Court with landscaping and ARC proof

The Board of Zoning Appeals approved a variance to allow an attached covered porch at 3676 Farley Court to encroach 5 feet 8 inches into the 30-foot rear-yard building setback. Chair (S2) moved to approve VAR 43-20-26 with two conditions: that the applicant install landscaping screening on the south and north sides in consultation with city staff, and that the applicant provide proof of the New Albany Country Club Architectural Review Committee (ARC) approval to city staff at the time of permitting.

City planning staff had described the structure as approximately 345 square feet with about 108 square feet encroaching into the setback and noted the paver patio (uncovered) was permitted to encroach up to 5 feet. “The applicant is requesting an approach into this 30 foot rear yard setback by 5 feet and 8 inches,” staff (Jay, S5) said during the presentation. The board adopted staff’s recommended condition requiring landscape screening and a requirement to submit ARC/HOA documentation before permit issuance.

Applicant representative George Cleary (S7) said the project had gone through ARC reviews and that the design team would comply with the board’s conditions. The motion carried on a roll call with members recorded on the record as voting in the affirmative; the chair declared, “The ayes have it. Application passes.” The approval allows the applicant to move forward with permitting subject to the stated conditions.
